1. Introduction

Welcome to MonteTours Costa Rica (“MonteTours”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website and the services we provide as a platform that connects travelers with independent third-party tour, transportation, and activity operators (“Third-Party Operators”).

By using our website, browsing tour information, or booking any service through MonteTours, you acknowledge that you have read, understood, and agreed to these Terms.

2. Nature of Our Service (Important Disclaimer)

MonteTours is not the direct provider of tours, transportation services, guided activities, or any other travel experiences.

We operate solely as a reseller / booking intermediary.
All experiences listed on our website are designed, operated, insured, and executed by independent Third-Party Operators.

This means:

  • Third-Party Operators are fully responsible and liable for delivering the service.
  • Third-Party Operators are required to maintain their own operational licenses, permits, and insurance coverage (liability, accident, and passenger insurance, as required by Costa Rican law).
  • If there are accidents, injuries, delays, cancellations, equipment failures, or operational issues, the responsibility belongs to the independent operator, not MonteTours.

MonteTours does not own vehicles, equipment, facilities, or guiding services and does not supervise or control the daily operations of Third-Party Operators.

3. Booking with Third-Party Operators

When booking through MonteTours:

  • You enter into a direct contract with the Third-Party Operator.
  • MonteTours facilitates reservations, payments, and communication, but is not the operator of the service.
  • Operator-specific terms (cancellations, refund rules, age limits, safety requirements) apply.

We provide the most accurate information possible, but ultimate responsibility for service conditions and updates lies with the Operator.

4. Cancellations & Modifications

Each service has its own cancellation policy, established by the Operator.

  • Refund eligibility follows that Operator’s policy.
  • Some services are non-refundable.
  • MonteTours assists with communication, but does not make refund decisions—Operators do.

If an Operator changes or cancels a service, they are responsible for offering alternatives or refunds per their terms.

5. Liability & Insurance

Because MonteTours is not the operator:

  • We do not provide insurance.
  • We do not accept liability for accidents, injuries, delays, or operational failures.
  • All incidents must be handled through the Operator’s insurance and/or directly with the operator.

We strongly recommend travelers obtain personal travel insurance.

6. User Responsibilities

By using MonteTours, you agree to:

  • Provide accurate information.
  • Review Operator rules and safety guidelines.
  • Follow Operator instructions during tours and activities.

MonteTours is not responsible for issues arising from incorrect information or non-compliance with Operator instructions.

7. Website Content & Accuracy

MonteTours strives to display up-to-date descriptions, itineraries, pricing, and images.
However, we do not guarantee:

  • Accuracy
  • Availability
  • Completeness

Changes may occur without notice.

8. Payments

Payments are processed on behalf of Operators.

  • Charges may appear as MonteTours or an authorized processor.
  • Bookings are confirmed only after successful payment.
  • Taxes and fees may vary.

9. Disclaimers

MonteTours provides its website “as-is” and does not guarantee uninterrupted access.
We are not responsible for:

  • Weather
  • Road conditions
  • Wildlife
  • Force majeure
  • Operator decisions
  • Safety incidents caused by Operators

10. Indemnification

You agree to indemnify and hold MonteTours harmless from:

  • Claims related to the conduct or negligence of Operators
  • Violations of Operator policies
  • Damages caused during participation

11. Modifications to Terms

MonteTours may update these terms at any time.
Continued use of the site implies acceptance of updates.

12. Governing Law

These Terms are governed by the laws of Costa Rica.
Disputes related to booked services must be addressed directly with the Operator.
